$9 million: Verdict for victim of shooting

Our client was physically harmed and emotionally traumatized after he was shot numerous times by a home invader. Cubit & Cubit represented the client, who ultimately achieved a verdict in excess of $9,000,000 against the home invader and the home invader’s insurance company. At the time, it was the largest verdict in Dade County for the year.

$1.8 million settlement : Behalf of family of wrongful death victim

Cubit & Cubit represented the family of a young man who was struck by an oncoming vehicle while crossing the street. The insurance company denied the claim, contending that the young man darted into the path of the driver. Our legal team obtained the cell phone records of the driver who was operating the vehicle that struck our client. We were able to prove that that the driver was on the cell phone prior to hitting the young man, and therefore his negligence caused the accident. Although the defendant’s attorney attempted to use an extensive litigation process to frustrate our client, we were able to win a settlement in excess of $1,800,000 million dollars, just prior to trial.

$750.000 settlement: Against funeral home found guilty of negligence

Cubit & Cubit was asked to represent the family of a man who had recently passed away. Shamefully, the funeral home neglected to keep the body of the deceased in proper condition as it was transported from the family´s home to the funeral parlor. This resulted in the deterioration of the body. Cubit & Cubit sued the funeral home and ultimately won a settlement in excess of $750,000.

$800,000 awarded: Admiralty case represented by Cubit & Cubit

Cubit & Cubit represented a young lady who was on board a vessel in Fort Lauderdale, Florida. While on board, an invader entered the vessel and stabbed our client multiple times. Thankfully, our client survived. To obtain restitution for her physical and emotional injuries, she turned to Cubit & Cubit for help. Through diligent research of case law, Cubit & Cubit was able to use provisions in the Admiralty and Longshoreman acts to win a settlement in excess of $800,000 on behalf of our client.

$150,000 settlement: Awarded for client suffering traumatic heart attack in auto accident

The Law Offices of Cubit & Cubit represented a gentleman who was injured in an automobile accident that was caused by another driver. Several weeks after the automobile accident, the gentleman had a heart attack, from which he fortunately recovered. The Cubit & Cubit legal team was able to prove that the heart attack was ultimately the result of trauma caused by the accident. In so doing, we obtained a settlement from the insurance company of the driver who caused the accident. The settlement amount was in excess of $150,000.

Settlement: Cubit & Cubit successfully fights for client to receive settlement in excess of insurance company policy limits for motorcycle accident

The family of a person who was killed in a motorcycle accident asked Cubit and Cubit to act on their behalf with a claim filed by their insurance company. This was because the insurance company had made no attempt to settle the matter in a timely manner. Cubit & Cubit immediately filed a lawsuit based on Florida statutes that require insurance companies to settle such claims in a timely and reasonable manner. By proving that the insurance company had failed to act in good faith and in compliance with the statutes, we were able to obtain a settlement that was 40% more than the stated limits of the life insurance policy.

$3,976,500.00 Awarded: Awarded for wrongful death from auto accident

On December 1, 2008, Artiffany Binder's life came to a tragic end. Artiffany, a registered nurse, was travelling home from her shift when she was struck by a drunk driver. Artiffany left behind her loving husband. The Estate of Artiffany Binder retained Thomas M. Cubit of the Law Offices of Cubit and Cubit. After an extensive litigation, and eventually a jury trial, an award was entered. On November 17, 2011, a jury verdict was awarded to the Estate of Artiffany Binder in the amount of $3,976,500.00.
